These terms of use (the “Terms of Use”) apply to anyone who has an account on Lovely Render (the “User”). They are accepted when the account is created. Site visitors are not Users: they follow what each site tells them.
An organization’s subscription to the service (plans, prices, duration, reversibility) is governed by the terms of sale (the “Terms of Sale”), whose definitions apply here.
Article 1. The account
The User creates their account with their first name, last name, email address and a password, or by accepting an invitation. The account is only active once the address has been confirmed with the code sent by email. An account that is never confirmed is deleted after two days. The User provides accurate information and keeps it up to date.
An account is personal. It is not shared: each person who works on a site has their own account and their own role.
1.1. Account security
On a device Lovely Render does not recognize, the password is never enough: a second step is required, through an authenticator app or a code sent by email.
The User keeps their login credentials and backup codes confidential. If they receive a code or an alert they did not trigger, the This wasn’t me link in the email logs them out of all their devices. They then change their password.
The User notifies Lovely Render without delay if they believe their login credentials are compromised, from the Contact page. Lovely Render may suspend the account while it is secured.
Article 2. Members, roles and owners
A User accesses a site as a Member, with the role a site administrator gives them.
| Role | Rights |
|---|---|
| Administrator | Manage the site and its Members. Publish and restore the site if they have the Can publish right. |
| Editor | Create, edit and publish all content in Staging, without publishing the site. |
| Author | Create, edit and publish their own content in Staging, without publishing the site. |
| Contributor | Write content without publishing it. |
| Subscriber | Minimal access, without changing anything. |
Owners are Members with the Administrator role, appointed by Lovely Render when the site is opened or at the client’s request. Another administrator can neither remove them nor change their role. Only Owners can export the whole site, and each is notified of the others’ exports.
An administrator invites a Member by email. The invitation is valid for seven days. Removing a Member cuts off their access immediately. Their content stays on the site.
Article 3. AI assistants
A Member may authorize an AI assistant to act on a site. They never give it more than their role allows and choose the rights they grant it when authorizing it. They can withdraw this authorization at any time.
The assistant’s actions are taken in the name of the Member who authorized it and engage their responsibility as their own actions do. They are recorded in the site’s history.
The data the assistant reads passes through its provider. The Client is responsible for this processing, which is governed by the contract made with that provider.
Article 4. Rules of use
The User shall not:
- publish unlawful content: infringing, defamatory, hateful, violating a person’s privacy or dignity, or inciting an offence;
- use a site to deceive its visitors: phishing, collecting data under a false pretext, impersonating a third party;
- distribute malware, or send unsolicited messages through a site’s forms or emails;
- attempt to access a site, an account or data they are not entitled to, bypass the service’s quotas or protections, or disrupt its operation;
- use a site as a video hosting or distribution platform, beyond the videos that accompany its pages (Terms of Sale, article 9).
Article 5. Published content
The client and its Members publish their site: they choose what they publish on it and are responsible for it. Lovely Render is its host, within the meaning of Regulation (EU) 2022/2065 on digital services (“DSA”) and of the French law on confidence in the digital economy (LCEN). Lovely Render does not check content before it is published.
5.1. Reporting content
Anyone can report content they believe is unlawful with the Report content form on the Contact page. Your report states:
- the exact address of the page that publishes the content;
- why you believe the content is unlawful;
- your name and email address, except for child sexual abuse material, which you can report without giving your name;
- a sentence in which you declare in good faith that your report is accurate and complete.
Lovely Render acknowledges receipt of each report, examines it and informs its author of the action taken.
5.2. Moderation
On a well-founded report, or if it finds unlawful content or content contrary to the Terms of Use itself, Lovely Render may make the content inaccessible, suspend an account or deactivate the site. It states its reasons to the client and to the User concerned, unless the law prevents it.
The client or the User may challenge the decision by replying to the email that announces it, within six months. Lovely Render reviews the decision and replies to them.
5.3. Point of contact
Authorities and Users reach Lovely Render through the forms on the Contact page, in French or in English.
Article 6. History
Actions taken on a site (publications, restores, exports, invitations, changes to Members, settings, content or design) are recorded in its history, with their author and date. The site’s administrators view it from the dashboard. No one can erase it from the site. It is kept for 12 months and erased with the site.
Article 7. Availability
Lovely Render takes the necessary measures to keep the service available. It may interrupt it for maintenance announced at least 48 hours in advance, or without notice for the security of the service or its Users. The availability commitment to the client appears in the Terms of Sale.
Article 8. Your personal data
Lovely Render processes the User’s account data to provide the service to them and keep it secure. Names are stored encrypted. The Privacy policy page describes which data, what for, for how long and how to exercise your rights.
The client is the controller of the data of its site’s visitors, except for the IP addresses Lovely Render processes for the security of the platform. The data processing agreement sets out their commitments.
Article 9. Suspension
In the event of a breach of the Terms of Use, Lovely Render may, depending on its seriousness, remove content, deactivate the User’s account or deactivate the site concerned. A deactivated site is no longer accessible to the public; its Members keep access to its Staging and its Owners can export it. Lovely Render states its reasons as provided for in article 5.2.
Article 10. Intellectual property
The service, its engine, its blocks, its animations and its code belong to Lovely Render. The User has a personal right of use for the duration of their access. A site’s content belongs to the client, under the conditions of the Terms of Sale.
Article 11. Changes to the Terms of Use
Lovely Render informs Users by email of any change to the Terms of Use at least one month before it comes into force. Continuing to use the service after that date constitutes acceptance. A User who refuses it requests the deletion of their account from the Contact page.
Article 12. Governing law
The Terms of Use are governed by French law. A dispute with a User acting for their professional activity is brought before the courts within the jurisdiction of the Orléans Court of Appeal, or before the Orléans Commercial Court if both parties are traders. A User acting outside any professional activity may bring the matter before the court of their place of residence.
